The Will of James HORRY of Navenby
"This is the last Will and Testament of me James HORRY of Navenby in the County of Lincoln, Miller.
First I Give and Bequeath All that my Messuage or Tenement, Garden and Appurtenances thereto belonging situate and being in Navenby aforesaid which I hold by Lease for Years under the Dean and Chapter of Lincoln, and All my Rights and Interest in the said Lease (and now in the Tenure of Mr. Henry ONYON) unto my Wife Elizabeth HORRY during the Term of Her natural Life, and after my said Wife Elizabeth HORRY departing this Life Then I Give and Bequeath the aforesaid Messuage or Tenement with the Appurtenances thereto belonging unto my son James HORRY his Executors Administrators and Assigns for Ever
Also I Give and Bequeath unto my two Sons Henry HORRY and John HORRY the Sum of five Hundred Pounds apiece
Also All the rest residue and Remainder of my Messuages or Tenements with the Appurtenances thereto belonging together with all my Freehold Lands, and Leasehold Lands situate and being in Navenby aforesaid which I hold by Lease for years under the Dean and Chapter of Lincoln, and All my Right and Interest in the said Lease unto my said Son James HORRY his Executors Administrators and Assigns for Ever
Also I Give and Bequeath All that my Wind-Mill situate standing and being in the Lordship of Boothby Graffoe in the said County of Lincoln together with the Appurtenances thereto belonging unto my said son James HORRY his Heirs and Assigns for Ever. And I will and direct that my said Son James HORRY shall keep Maintain and provide for my said Wife Elizabeth HORRY during the the Term of Her natural Life
And in Case my said Son James HORRY should Marry or Should my said Wife have a desire to part, Then in such Case I hereby make my Freehold Lands, Leasehold Lands, and Tenements chargeable with One Annuity or yearly Sum of Sixty Pounds of Lawful Money of Great Britain free of all Taxes and Deductions whatever to be paid and payable out of All my said Freehold and Leasehold Estates, Mill and Premisses to be paid and payable to my said Wife during the Term of Her natural Life by four equal Quarterly Payments, that is to say The Feast of the Annunciation of the blessed Virgin Mary, the Nativity of Saint John the Baptist, Saint Michael the Archangel and the birth of our Saviour Christ by even and equal Proportions. The first Payment thereof to begin and to be made on such of the said Feasts or days of Payment as shall first happen next after my said Wife leaving my said Son James HORRY And to be continued has (sic) herein before specified so long as my said Wife shall Live
And my Will also is that in Case my said Wife should leave my said Son James HORRY then I give and Bequeath unto my Wife as much Furniture as will Furnish two Rooms which Furniture shall be of her own Choosing.
And I further will and Direct that my said Son James HORRY shall Cloath and provide for my two Sons Henry HORRY and John HORRY till they shall severally attain the Age of Twenty-one Years And in Case my said Wife and my said Son James HORRY should part my Will and desire Also is that my said Son James HORRY shall have the Priviledge at all Times of having Water from the Well now standing on the Messuage or Tenement now in the Tenure of the said Henry ONYON
And I do hereby will and Direct that my Executor shall pay to each of the Legatees the Sum of Two Hundred and Fifty Pounds apiece part of their several Legacees herein before Given and Bequeathed when they shall severally attain the Age of Twenty-one Years
And the Remainder part of the said Five Hundred pounds apiece to be paid by my Executor, his Administrators or Assigns at the Expiration oftwelve Calendar Months next after the Decease of my said Wife.
And in Case of any of their Deaths before my said Wife then the share or shares of him so dying, to go to the Child or Children of him so dying share and share alike.
All the rest residue and Remainder of my Goods Chattells Effects and Personal Estate whatsoever and wheresoever Subject to the Payment of all my just Debts Funeral Expenses and the Expences of Proving this my Will I give and Bequeath unto and for the absolute use and Benefit of my said son, James HORRY his Executors Administrators and Assigns for ever
And lastly I do hereby Constitute Nominate and Appoint my said Son James HORRY Sole Executor of this my last Will and Testament
In Witness whereof I the said James HORRY have to this my last Will and Testament contained in two sheets of Paper set my Hand and Seal that is to Say to the first sheet set my Hand and this last my Hand and Seal this fourth day of January In the Year of our Lord one thousand eight Hundred and thirteen.
