| 3651 | JOHN WESTMORELAND 1812-1878 John WESTMORELAND was baptised at Wigtoft, Lincolnshire, on 25 October 1812. (source: email from keith.is@tiscali.co.uk) The marriage between Beersheba SIVILLS and John WESTMORELAND was registered in 1838. (GRO March Q 1838 Spalding 14 623) He was tried at the Holland Sessions in Boston, Lincolnshire, on 26 June 1848 for the felony of killing a sheep with intent to steal and was sentenced to be transported for 10 years. Nineteen year old Charles LEFEVRE was also found guilty and received the same sentence. His twenty eight year old brother Abel WESTMORELAND was found not guilty. (HO27/85/283) He was transported to Van Diemen's Land (later Tasmania) on the vessel Rodney, departing on 19 September 1851. He was 32 years old and unmarried (RG9/3555). From his father's will proved at York on 14 June 1866: "And I give devise and bequeath all my messuages lands tenements and hiraditaments (sic) situate at Naburn aforesaid and at Lingcroft or elsewhere in the said County of York and all other my real estate whatsoever and wheresoever And also all my money securities for money goods chattels personal estate and effects whatsoever and wheresoever Unto my son JOHN WHARRAM his heirs executors administrators and assigns according to the nature and tenure thereof respectively Subject nevertheless to the payment of my just debts funeral and testamentary expenses and the legacies hereinbefore bequeathed I appoint my said son JOHN WHARRAM sole Executor of this my Will". the Public Stocks or Funds or Government Securities or upon Mortgage of Freehold or Copyhold Estates in England or Wales And I hereby direct or declare that the trustees or trustee for the time being of this my Will shall stand possessed of the Stocks funds or securities in or upon which the aforesaid trust monies shall be invested Upon Trust from time to time t t to pay the interest dividends and annual produce thereof unto my said Wife Elizabeth or permit or empower her to receive the same during the term of her life And from and immediately after her decease Then as to and concerning as well the said Stocks funds and securities and the dividends interest and annual produce thenceforth to arise therefrom as also the of the clear residue of the monies to arise from the sale of my aforesaid Freehold and Copyhold estates under the trusts hereieinbefore contained Upon Trust to pay and divide the same unt and equally amongst all and every the children of my Brothers and Sisters William PILKINTON Thomas PILKINTON deceased Robert PILKINTON Sarah COOPER deceased Mary HINCHLIFF deceased anand Charlotte LOVELL deceased and the Children of my Wife's half Sister Jane ONN deceased who shall be living at the time of my decease and the issue then living of any of the said Children who may have died in my liftime [sic] such issue to takke only the share or respective share which his her or their parent or respective parents if living would have been entitled to And in case any such children or their issue shall be under the age of twenty one years or unmarried as aforesaid at the time of the decease of my said Wife then I direct my said trustees for the time being to invest the expectant or presumptive share or respective shares of such children or their issue respectively at Interest And I empower and direct my said Trustees for the time being (in their absolute discretion and as they shall see fit) to apply the interest dividends and annual produce arising from the respective shares or expectant shares or the whole or any part of the principal of such respective shares or expectant shares to which any such Children or their issue respectively shall be actually or presumptively intitled under the trusts aforesaid to and for the maintenance and education or advancemement in the world of such children respectivelyor their issue respectively or inthe discretion of the said Trustees to pay the same or such part thereof as they shall deem adequate for the purpose to the surviving parent or other the Guardian of such children children or their issue respectively to be so applied during their respective minorities And I direct that my trustees shall not be resp[onsible for the due application of any monies which they shall so as aforesaid pay to the surviving parent or guardian of any of the aforesaid children or their issue nor shall be bound to enquire into the ability of the parents of such Children and issue as aforesaid to provide for his or her maintenance education or advancement in the World And I hereby nominate and appoint my said Nephew Thomas PILKINTON and George PILKINTON and the said Maurice Peter MOORE Executors of this my Will And I Give devise unto the said Executors and their heirs All the land and hereditaments vested in me as Trustee or mortgagee To hold the same unto and To the Use of them the said Executors their assigns Upon and subject to the several trusts and equities for the time being affecting the same hereditaments respectively And I declare that when and so often as any cacancy shall occur in the Office of Trustee under this my Will by reason of the death (whether in my lifetime or after my decease) ['renominate' crossed out] renunciation incapacity or resignation o o or refusal to act of any Trustee for the time being it shall be lawful for the surviving or continuing Trustee or Trustees for the time being or if there be no such Trustee then for the executors or administrators of the last deceased Trustee or if there be no such last mentioned person then for the renouncing or retiring Trustee or Trustees to nominate a new Trustee or Trustees to supply such vacancy or vacancies respectively And I hereby declare that my said Executors and trustees for the time being shall not be answerable for each other or for involuntary losses And that they shall be allowed and may retain all their cash and expenses to be incurred in the due execution of the trusts hereby in them reposed And that every person paying money to such executors and Trustees shall be exonerated from all
